Job Summary: The Appeals Coordinator will be a subject matter expert and able to provide person-centered assistance agency-wide on appeals and 4731 complaints received by the Regional Center.
Responsibilites will include, but will not be limited to, coordination and resolution of Lanterman appeals, Early Start appeals and complaints, and 4731 complaints, as well as to provide training and support to all Regional Center staff around the various appeals and complaint processes.
Primary Job Functions: Appeals 1.
Provides consultation and training to staff on the appeals process.
2.
Tracking and assigning of appeals for Services and Supports.
3.
Maintains and coordinates timelines during appeal process as required by law.
4.
Provides training and support to Regional Center designee/Services and Supports Manager through the appeals process up to and including the appeals hearing, with the focus always being on resolution at the lowest level.
5.
Helps to guide the Regional Center designee/Services and Supports Manager through the entire appeals process.
6.
Assists Regional Center designee/Services and Supports Manager in informal meetings regarding appeals.
7.
Helps to guide the Regional Center designee/Services and Supports Manager in representing the Regional Center in mediations and fair hearings conducted by the Office of Administrative Hearings, up to and including participating in both mediations and appeals hearings.
8.
Assists in formulating and providing a written response to all parties as required.
9.
Supports the Regional Center designee/Services and Supports Manager in scheduling and completing administrative tasks related to the appeals process.
10.
Assists in preparing individuals to act as a witness for the Regional Center in an appeals hearing.
11.
Assists in creation of evidence packets for appeals.
12.
Assist in compositon of correspondence when necessary to families, attorneys, other regional centers, Office of Administrative Hearings (OAH), and Department of Developmental Services (DDS).
13.
Consultion and training with all TCRC staff on the appeal process in such areas as measures to prevent appeals, negotiating settlements, preparation and attendance at informal meetings, administrative hearings and mediations.
14.
Other duties may be assigned as needed.
4731 Rights Complaints Assist in conducting investigations of complaints filed in accordance with section 4731 of the Lanterman Developmental Disabilities Act within mandated timelines.
Should the 4731 complaint be appealed, assist in composition of the response and proposed resolution for the complaint.
Assist in facilitating any follow up activities related to potential 4731 findings, such as Plans of Correction (POC) and assist in the coordination of a response.
Track W&I Code 4731 complaints and assist in reports to DDS on a quarterly basis.
Administrative & Training Provides consultation and training to staff on the requirements of the Lanterman Act, Title 17, IDEA, California Code or Regulations, Educational Code, and Purchase of Services guidelines.
Prepares statistical and written reports as needed for the Director of Services and Supports, other Executive Staff, and for the TCADD Board.
Prepares statistical and written reports for DDS required reporting.
Maintenance of electronic files for appeals cases.
Creates status reports as needed related to appeals.
Represents the Regional Center in a variety of inter-agency committees, task forces, etc.
as assigned.
Stays updated with and provides guidance to Regional Center staff on new and changing laws and regulations related to appeals.
Provides training related to Lanterman timelines around service requests, Good Faith Letters, and Notices of Action.
Community training as needed.
Minimum Qualifications: Education and Experience: Master’s (preferred) or Bachelor’s degree in human services field or a related area, with 4 or more years of experience working within the Regional Center system supporting individuals with I/DD.
Experience in using Person Centered Thinking (PCT) and Person-Centered Planning (PCP).
Regional Center experience related to the Lanterman Act as well as Early Start, preferably related to the appeals process.
Bilingual preferred (English/Spanish) Knowledge, Skills, and Abilities Knowledge of developmental disabilities.
Demonstrate cultural awareness and sensitivity and an ability to work effectively with culturally diverse populations in a variety of situations including excellent group facilitation skills.
Valid California driver’s license and reliable, insured vehicle or equivalent means of transportation.
This position will require regular travel outside of the home office catchment area, and can include occasional travel to state or national meetings.
Physical Requirements: Adequate manual dexterity and coordination for operation of a computer and other standard office equipment is required for this position.
The ability to sit at a workstation for long periods of time, the ability to read, write and comprehend large amounts of written material such as reports and regulations, use the telephone, and communicate via electronic mail are all required on a daily basis.
The ability to travel to another work-site location is absolutely required on a daily basis.
The ability to stand, sit or walk for moderate distances on uneven terrain is also required on a daily basis.
While performing the duties of this job, the employee is regularly required to use hands to finger, handle, feel or operate objects, tools, or control and reach with hands and arms.
The employee frequently is required to stand, sit, walk, push, pull, kneel, stoop, bend, and squat.
The employee must frequently lift and/or move up to 10 lbs and infrequently up to 20 lbs.
Specific vision abilities required by this job include close vision, distance vision, color vision, depth perception, and the ability to adjust focus.
Each of these physical tasks is an essential function of the position.
